Brazilian man who fatally struck Lethem woman pleads guilty to nine charges

Casmero Cyril Juan, a 26-year-old from Boa Vista, Brazil, who was involved in a fatal accident on Friday last on the Barrack Retreat Public Road in Lethem Commercial Zone has pleaded guilty to nine charges including causing death by dangerous driving.

Juan appeared Tuesday before Magistrate Omadatt Chandan at the Lethem Magistrate’s Court, where he was charged with the following offences:

  1. Causing Death by Dangerous Driving, Contrary to Section 35(1) of the Motor Vehicle and Road Traffic Act, Chapter 51:02.
  2. Driving a motor vehicle whilst breath alcohol level exceeded the prescribed limit, Contrary to Section 39(2)of the Motor Vehicle and Road Traffic Act, Chapter 51:02.
  3. Failing to Stop after accident, Contrary to section 62(1)(a) of the Motor Vehicles and Road Traffic Act, Chapter 51:02.
  4. Failing to render assistance to injured person, Contrary to Section 62(1)(C) of the Motor Vehicles and Road Traffic Act, Chapter 51:02.
  5. Taking Motor Vehicle without owner’s consent, Contrary to Section 108 (1)(a) of the Motor Vehicles and Road Traffic Act, Chapter 51:02.
  6. Unlicensed Motor Vehicle, Contrary to Section 22(1) of the Motor Vehicles and Road Traffic Act, Chapter 51:02.
  7. Uncertified Motor Vehicle, Contrary to Section 15 of the Motor Vehicles and Road�Traffic Act, Chapter 51:02.
  8. Unlicensed Driver, Contrary to Section 23(1) of the Motor Vehicle and Road Traffic Act, Chapter 51:02.
  9. Uninsured Motor Vehicle, Contrary to Section 3(1) of the Motor Vehicle Insurance (Third Party Risk) Act, Chapter 51:03.

The charges were read to him, and he pleaded guilty to all of them. He was remanded to prison, and the case was adjourned to April 16 for sentencing.

Pedestrian Shamell Lindie, a 48-year-old from Culvert City, Lethem Central, died in the accident after she was struck down by the pickup vehicle driven by Casmero Cyril Juan.
