The Bar Council of the Bar Association of Guyana on Wednesday issued a statement addressing recent public statements, particularly on social media, which have included personal attacks against judicial officers involved in ongoing or past court proceedings.
The Bar Council emphasized the need for responsibility when making public statements concerning the administration of justice and judicial officers. It condemned the use of threatening language, personal attacks, and the spreading of scandalous, inflammatory, or unsubstantiated allegations against judicial officers. Such actions not only disrespect the court but also undermine public confidence in the administration of justice.
Furthermore, the Bar Council reminded the public that such statements may constitute Contempt of Court under the Contempt of Court Act, Cap. 5:05, which carries penalties including imprisonment.
The statement reaffirms a previous position from July 24, 2020, asserting that while the public has the right to express concerns and criticisms towards the judiciary, these rights are not unlimited and must be exercised within the boundaries of the law and legal principles. Violations could lead to legal proceedings and potential imprisonment for offenders.
The Bar Council said it unequivocally condemns any statements that disrespect judicial officers and undermine the judicial process, emphasizing the importance of lawful and respectful public discourse concerning matters of justice.
“The Bar Council hereby issues an unqualified condemnation of any and all such aforesaid statements and reiterates its Statement made on July 24, 2020, that –
“While the Judiciary is not immune from public expressions of concern and criticism, such right is not unfettered and must be exercised within the ambit of the law and governing legal principles; the breach of which could result in legal proceedings being instituted against such perpetrator(s) and where applicable punishable by imprisonment.”
