Court rules in favour of Guyana Cricket Board; election of Bassarath to Cricket West Indies deemed unlawful

High Court Judge Navindra Singh on Monday ruled that the election of Azim Bassarath as Vice-president of Cricket West Indies (CWI) was null, void and of no legal effect being contrary to the Articles of Association of Cricket West Indies and the laws and rules governing elections.

Bassarath of Trinidad and Tobago was elected to the post at the last CWI election on March 25, 2023.

The court ruled that the office of the Vice-president is now vacant and has instructed CWI to hold a new election to fill the post. The court also ordered the sum of G$100,000 to be paid to the GCB on or before August 26, 2024.

Following the ruling on Monday, CWI has instructed its legal team to immediately file an appeal, and will await the decision of the appellate Court.

The Guyana Cricket Board (GCB) in January, 2023, nominated Bassarath for the position of Vice-president of CWI in accordance with the Articles of Association of CWI Inc.

The GCB later withdrew the said nomination prior to the election. The said withdrawal was done in writing and was premised on certain reports/information received by the GCB in relation to Bassarath’s conduct as President of the Trinidad and Tobago Cricket Board.

In October 2023, the GCB called for the resignation of Bassarath, questioning the “legal basis” of the March 25 elections at which the Trinidadian cricket administrator was elected.

Bassarath was elected unopposed; he gained six votes with two voting against, and four abstaining.
