Sentencing guidelines for consistent jail time in similar offences near completion

Attorney General Anil Nandlall has once again underscored the urgent need for comprehensive sentencing guidelines to address inconsistencies in judicial sentencing.

Speaking recently, Nandlall highlighted the troubling disparities observed in sentences for similar offences, calling for a reform that promotes uniformity and accountability within the judicial system.

Nandlall pointed out that many cases have illustrated the arbitrary nature of sentencing, where individuals charged with identical offences receive vastly different punishments.

He noted, “One man may be charged with robbery in one court and receive a year in prison, while another in similar circumstances may be sentenced to seven years in a different court. This inconsistency undermines public confidence in the legal system.”

The Attorney General announced that the long-awaited sentencing guidelines are nearing completion.

These guidelines, which are set to be made public, aim to inform judges and magistrates about the appropriate penalties for various categories of offences.

By standardising sentencing practices, the guidelines will provide clarity and transparency regarding the rationale behind judicial decisions.

“The principles guiding how a court arrives at a sentence should be clear and accessible,” Nandlall stated.

“With these guidelines, the public will have insight into the judicial process, allowing them to understand whether judges are adhering to the established framework or deviating from it.”

The initiative, while being a judiciary-driven endeavour, is heavily supported by the executive branch, reflecting a collaborative approach to judicial reform.

The completed guidelines are currently with the judiciary and are expected to return to the Attorney General’s chambers for final promulgation.
