The New Building Society Limited (NBS), thru Attorney at Law, Pauline Chase has applied for Writs of Certiorari and Prohibition against Minister of Communities, Ronald Bulkan for his approval of the City By-laws that brought the Parking meter project into being, knowing same to be unlawful or without legal effect.
According to the High Court document seen by News Room, Minister Bulkan has to respond by February 20, 2017, to the Order Nisi Certiorari, to “show cause why a writ of certiorari should not be issued to quash his approval/decision to approve the Parking Meter By-Laws made under the Municipal and District Councils Act, Chapter 28:01 made on or about the 23rd day of January 2017 in that the said approval or decision to approve was of no legal effect and was made unlawfully and in breach of statute”.
Town Clerk, Royston King is also named to be served with a copy of the Order.
The Smart City Solutions and Mayor and City Council’s regulated parking meter project has been at the centre of public debate and protest since its announcement.
However public protest gained momentum not only on social media but in real life about two weeks ago when the Minister Bulkan signed the By-laws for the project clearing the way for the parent company to charge motorists who used regulated spaces or to boot those who fail to pay or violate their regulations.
Citizens are protesting the secrecy surrounding the contract that gave birth to the project and the rate at which parking is being charged.
