Court case to determine declaration of elections results adjourned
The court case seeking to block the Guyana Elections Commission (GECOM) from declaring the March 2, 2020 elections results that would make APNU+AFC leader Brigadier David A. Granger President has been adjourned to 13:30hrs.
Chief Justice (ag) Roxane George adjourned the matter, which came before her at 10:30hrs on Saturday at the High Court, Georgetown.
The opposition People’s Progressive Party has filed additional affidavits, taking the total number to four, and the court needs time to peruse.
The Chief Justice indicated that Attorneys must be prepared to work hard, as an entire country awaits the outcome of the polls.
Neil Boston, the Attorney for the Returning Officer Clairmont Mingo, the Chief Elections Officer Keith Lowenfield and the Guyana Elections Commission, has asked for time to get acquainted with those affidavits.
Boston argued that the court has no jurisdiction “to determine the issue at this immediate stage; election is still in process. It can only be challenged pursuant to Article 163 of the Constitution by way of an election petition. There is no two-stage process.”
“The counter to that argument is the law so asinine that it will stand idly by and allow a clear illegality to take place and allow a completely illegal government to be installed and then step in to remove that very government?
“Meanwhile, the Government remains in power, an illegal government, and governs illegally using public funds illegally. I don’t think that this is what is contemplated by the law.”
The Chief Justice is hearing an injunction which was filed by the People’s Progressive Party after the Returning Officer of Region 4, declared unverified results for the region, claiming that the APNU+AFC Coalition received 136,458 votes and the PPP received 77,329 votes.
