Man gets 3-year prison sentence for causing death by dangerous driving

A three-year jail sentence was on Monday handed down by City Magistrate Judy Latchman to a 28-year-old truck driver after he was found guilty of a causing the death a 46-year-old man.

Sadath Newark was on trial for driving motor car PPR 378 in a dangerous manner causing the death of 46-year-old Conway on February 6, 2018 at Kuru Kururu, East Bank Demerara.

Evidence was led by police prosecutor Shawn Gonsalves while Newark was represented by attorney Sonia Parag.

According to the facts presented in court, on the day in question about 23:08 hrs, Newark was the driver of motor car PRR 378 which was proceeding East along Kuru Kururu Public Road.

It is alleged that Conway was standing on the side of the road next to his parked motor lorry when Newark’s car collided with him.

Conway was taken to the Diamond Diagnostic Centre where he was pronounced dead on arrival.

Magistrate Latchman noted that based on the caution statement given by Newark, he told the police that he noticed the lorry 40 feet away and had to put on his high beam lights to pass the vehicle.

“Mr. Newark…had ample time to avoid the accident,” the Magistrate said during his decision.

” If he was paying attention to the road he would have seen the lorry and the deceased” she added.

Magistrate Latchman noted that Conway died from blunt force trauma, a ruptured liver and spleen along with others skeletal fracture.
